The TomTom Cigars Marketplace (“Marketplace”), operated by TomTom Cigars Ltd. (“we” or “us”), is a platform exclusively for UK residents aged 18 and over to buy and sell boutique or rare cigars. By accessing or using our Marketplace, you agree to the following terms and conditions.

1. User Registration and Eligibility

To use our Marketplace, all users must create an account and verify both age and UK residency. Age verification is required to comply with UK tobacco regulations. New sellers may also need to provide proof of cigar authenticity prior to listing.

2. Product Listings and Compliance Requirements

All cigars listed must be pre-approved by our in-house Cigar Aficionado. Sellers must ensure full compliance with UK tobacco laws, including mandatory health warnings on packaging. Required documentation includes:

• Proof of Ownership: Signed documentation confirming the seller is the legal owner of the cigars.
• Certificate of Authenticity: Especially for high-value or vintage cigars, sellers should provide proof of authenticity from the original manufacturer or an authorized distributor, if available.
• Condition Report: Detailed information on the cigars’ age, storage, and condition, specifying whether packaging is sealed, opened, or intact.
• Seller Identification and Contact Information: Full name, address, phone number, and email for verification purposes.
• Proof of Age: Proof that the seller is over 18, which may include a scanned ID or age verification document.
• Compliance with UK Tobacco Laws: Confirmation that the seller adheres to all applicable UK tobacco regulations, including health warnings and advertising standards.
• Shipping and Storage Agreement: Sellers must cover all shipping costs to and from our facility for inspection, as per Marketplace requirements.
• Liability Disclaimer: Sellers acknowledge responsibility for the condition of cigars during shipment to our facility and will cover any damages incurred before receipt.

3. Shipping and Handling

Our Marketplace is restricted to shipping to UK addresses. All cigars must be UK duty-paid, and sellers bear responsibility for adhering to UK import/export laws. Sellers assume liability for accuracy, costs, and reliability of shipments; TomTom Cigars Ltd. is not liable for independently handled shipments.

4. Storage and Delivery Liabilities

TomTom Cigars Ltd. does not provide storage services. Buyers are responsible for any customs, duties, or applicable taxes. Sellers bear liability for any damage or delays in transit.

5. Payment Terms and Service Fees

All payments are processed through authorized high-risk payment processors. A service fee of 10% will be deducted from the final sale price. All transactions are securely processed, inclusive of VAT and any additional required charges. Seller payouts are completed by wire transfer.

7. Returns, Cancellations, and Refunds

 Buyers may request a return or cancellation if items are misdescribed or defective. Refunds will be issued following a case-by-case assessment. Users must inform us promptly regarding issues and provide details on the transaction.

8. Compliance with UK Tobacco Advertising Laws

Advertising and promotion of tobacco products are governed by strict UK regulations. TomTom Cigars Ltd. promotes the Marketplace solely through educational content, adhering to UK restrictions on direct advertising. Sellers agree to abide by these regulations.

9. Data Privacy and Protection

In accordance with GDPR, TomTom Cigars Ltd. prioritizes the privacy of user data. Personal information is collected solely for account setup, transaction processing, and verification purposes and will not be shared with third parties without user consent.

10. Platform Limitations and Liability

TomTom Cigars Ltd. does not guarantee uninterrupted platform access and is not liable for delays or technical disruptions outside our control. Users acknowledge that occasional temporary interruptions may occur, for which we cannot be held responsible.
