The TomTom Cigars Auction House (“Auction House”) is a premier online platform dedicated to the sale of authenticated cigars. Currently, only TomTom Cigars' own stock is available for bidding, with potential plans to include third-party sellers in the future. By participating in our auction, you agree to the following terms and conditions.

 1. Introduction and Eligibility

• Purpose: The Auction House is designed for the sale of genuine cigars, providing a secure and transparent environment for buyers and sellers alike.
• Eligibility: To participate in the Auction House, users must be UK residents and at least 18 years of age, in compliance with UK tobacco laws.
• Registration: All users must create an account and agree to these Terms and Conditions before participating in any auction.
• If the listing is approved by our in house Cigar Aficionado, it will be eligible to get listed on our website

2. Auction-Specific Terms

• Binding Bids: All bids placed are legally binding. If you are the highest bidder at the close of the auction, you are obligated to complete the purchase.
• Bid Increments: Minimum bid increments are either set manually or automatically, depending on the auction lot. We  reserves the right to adjust bid increments at our discretion.
• Automated Bidding (Proxy Bids): If enabled, automated or proxy bidding allows users to set a maximum bid. The system will automatically increase your bid in the smallest possible increments until your maximum bid is reached.
• Outbidding Notifications: Participants will be notified via email or SMS if they have been outbid on a lot they are bidding on.

3. Winning and Payment

• Invoice: Upon winning a bid, the winning bidder will receive an invoice that includes the hammer price, buyer’s premium, taxes, and applicable shipping fees.
• Payment Deadline: Payment must be completed within 48 hours of the auction’s conclusion. Failure to do so may result in penalties or suspension from the platform.
• Payment Methods: Accepted payment methods include credit/debit card and bank transfer. All transactions are securely processed.

4. Buyer’s Premium and Additional Fees

• Buyer’s Premium: A buyer's premium of 15% will be added to the final hammer price of each lot. This is in addition to any applicable taxes, duties, and shipping fees.
• Taxes and Import Duties: Buyers are responsible for paying any taxes or import duties applicable to their purchase, as required by UK law.
• Sellers will need to pay for sending and receiving back the items after they have been checked and sealed by our in house cigar aficionado.

5. Non-Payment and Penalties

• Non-Payment Consequences: Failure to make payment within the specified period may result in penalties, including the suspension or permanent removal of the bidder’s account, and legal action if necessary.
• Second Chance Offers: If payment is not received, the item may be offered to the next highest bidder at their bid price or relisted for a future auction.

6. Returns, Disputes, and Condition Discrepancies

• Returns Policy: Returns are accepted only in cases where there are significant discrepancies between the item description and the item received. Please refer to our returns page for full details.
• Dispute Resolution: If a dispute arises regarding a purchase, we encourage both parties to contact us directly. We offer a review process and may involve arbitration in accordance with applicable laws.
• Maximum listing is for 1 month.

7. Shipping and Liability

• Shipping: Shipping arrangements will be handled by the client . Shipping costs are the responsibility of the buyer, and all items will be securely packaged for delivery.
• Liability for Damage: While TomTom Cigars will try its best to ensure the safety of the items,  the buyer assumes responsibility for damages that occur after shipment. Optional insurance may be available.

8. Privacy and Data Security

• Data Collection: We collect personal information such as your name, address, and payment details for account creation and transaction purposes. This information is securely stored and will not be shared with third parties without your consent.
• GDPR Compliance: As part of our commitment to data protection, we adhere to GDPR standards and ensure that all user data is handled with the highest level of security and privacy.

9. Intellectual Property and Copyright

• Content Ownership: All content on the Auction House website, including images, descriptions, and trademarks, is the property of TomTom Cigars Ltd. and is protected by copyright and intellectual property laws.
• Use of Website Content: Unauthorized use or reproduction of any content from our website is prohibited. Users are granted limited access solely for the purpose of browsing, bidding, and purchasing items from the Auction House.

By participating in the TomTom Cigars Auction House, you acknowledge that you have read, understood, and agree to these Terms and Conditions. These terms may be updated periodically to ensure compliance with UK laws and regulations.
